Over the past decade, support for reexamining and reconsidering the U.S. model of ethics review for protocols involving research with humans has grown, particularly for studies involving participants from multiple locales and organizations. The HMO Research Network received an infrastructure-building contract in 2004 that enabled us to evaluate issues in multi-institutional IRB review, examine possible changes, and propose a new model. We conducted key informant interviews and held meetings with IRB personnel, administrators, and researchers, eventually resulting in networkwide agreement to (...) pilot an alternative model of IRB review for minimal-risk, data-only studies that only entailed use of computerized data from our network sites. This article describes the organizational and interpersonal processes that led to the successful establishment of this alternative model, to inform other research consortia considering new multisite review models. This paper critiques the version of the argument that the regulation of hateful speech by the state undermines its democratic legitimacy made by Ronald Dworkin and James Weinstein. It argues that in some cases the harmful effects of hateful speech on the democratic process outweigh those of restriction. It does not challenge the central premise of the Legitimacy Argument, that a wide-ranging right to freedom of expression is an essential political right in a liberal democracy. Instead, it uses ideal and (...) nonideal theory as a framework for judgements about the regulation of hate speech. The mistake underpinning the Legitimacy Argument is that it assumes that other conditions pervade that make an ideal democratic procedure possible when they do not. In reality the state can be put in a position where, whatever course of action it takes with regard to the regulation or non-regulation of hate speech, some citizens will not be able to participate fully in political deliberation. Under such conditions there remain strong pro tanto reasons not to regulate hate speech on democratic grounds, but they are not all-things-considered reasons, and there are also pro tanto reasons to regulate hate speech that might outweigh them in some cases. This leads to the cautious conclusion that while there might be a normative justification for the regulation of hate speech in individual instances, the debate is best understood as one between competing pro tanto reasons, and must be approached on a case-by-case basis. Education must be good for something, and personal well-being is a plausible candidate for this role. The informed desired account of personal well-being has particular advantages so far as education is concerned, but it is vulnerable to criticism on grounds relating to the objectivity of prudential value. Accounts which avoid this problem, on the other hand, are exposed to objections from the libertarian standpoint, and in terms of their adequacy to reflect the distinctive value of education. Drawing on contemporary pragmatic philosophy and grounded in a reading of techniques associated with digital media as sophist practices of influence and manipulation, this paper proposes an ‘experimental’ reading of key aspects of the topological qualities of the infrastructure of the knowledge economy, with its obsessive attempts at measuring, recording and monitoring, or ‘qualculation’. Taking seriously, albeit with humour, early criticisms of actor-network for its ostensibly Machiavellian proclivities, it offers a series of playful stratagems for the exploration and analysis of (...) power as an emergent property of socio-technical relations. Topology, in this account, becomes relevant to cultural analysis because of the way that it allows us to think together processes constructive of the intensive continua of ‘desiring production’ with the sociotechnical operations of digital media infrastructures. Different elements operative within digital media (the super-hub, the power of small numbers, recursion and relational databases) are read stratagematically – as figures of a praxis (the material practice of immaterial labour), that reveals different facets of the operations of power, while also allowing for counter-tactics to be deployed. Rather than proposing a theoretical account or an empirical analysis, the paper develops what Stengers (2011) calls ‘operative constructs’, which become ingredients for further active exploration of and thinking about the topological qualities of mediatic infrastructure. The paper addresses four different and overlapping areas of digital media from a point of view that considers the plural, compositional quality of media/power relations. (shrink)

In the aftermath of the ‘Brexit’ referendum two pieces of campaign material used by the successful Leave campaign proved controversial: a slogan on the side of a bus fallaciously implying that leaving the EU would necessarily free up £350 million a week for the NHS; and a poster stating that Britain was at “Breaking Point” – purportedly due to an influx of migrants – that was redolent of Nazi propaganda. This paper analyses and develops some criticisms that were levelled at (...) the Leave campaigners who authorised these from the perspective of political liberalism. It concludes that those behind the Breaking Point poster could justifiably have been subject to non-criminal sanction by institutions such as the Electoral Commission, but that this is not the case for the NHS bus. The Breaking Point poster warrants sanction because it belongs to a category of hateful speech that propagates false and discriminatory beliefs about its targets. Where these are disseminated by those in authority or of high status, such as political campaigns, they can strengthen these beliefs amongst the rest of the population. This can lead to members of the targeted group being unable to deliberate effectively as they are not treated with adequate respect in political discussions, which in turn undermines the process of public justification. As a result, it undermines public justification in a way that false factual claims do not, eventhough in this case the NHS slogan appears to have had a greater effect on the referendum result. Traditional analytical philosophy of education assigns a peripheral place to physical education, partly because orthodox epistemology finds its cognitive claims implausible. An understandable but dubious response to this state of affairs is the attempt to relocate physical education within the academic curriculum, with its characteristic emphasis on theoretical knowledge and formal assessment. Dissatisfaction with this response suggests an analysis of physical activity in terms of practical knowledge or knowing how, but the results of this seem inconclusive. More recently, the development (...) of neurocomputational and embodied-cognition approaches in cognitive science appears to offer alternative ways of understanding motor skill and physical activity, and thus of rescuing physical education from its marginal status. But these strategies are not unproblematic, particularly where questions of personal agency and motor control are concerned. Examination of these issues prompts a radical reconsideration of the traditional problem of physical education, and consequently of some familiar assumptions in the philosophy of education. (shrink)

Policies are often justified to the public with reference to factual claims that most people cannot easily verify or scrutinise because they lack relevant knowledge or expertise. This poses a challenge for theories of public justification which require that laws are justified using reasons that all can accept. Further difficulties arise in cases such as the response to the ongoing COVID-19 pandemic where the factual base of knowledge used to justify policies is limited, subject to a high degree of disagreement (...) amongst experts, and marked by rapid changes. This paper reviews some strategies that public justification theorists might draw on to address the question of how to justify policies that depend on this kind of expert knowledge. Whilst such strategies cohere with existing theories of public justification, they do not yield intuitively attractive recommendations. Ideally, theories of public justification would provide criteria by which to evaluate expert testimony such that it guides and informs, but does not lead, policy making. However, in cases like the pandemic response, theories of public reason currently tend towards recommendations that are intuitively unattractive: either requiring citizens to defer to ‘experts’ in a fairly uncritical way or being overly permissive of most factual claims. This book examines influential conceptions of sport and then analyses the interplay of challenging borderline cases with the standard definitions of sport. It is meant to inspire more thought and debate on just what sport is, how it relates to other activities and human endeavors, and what we can learn about ourselves by studying sport.

Thomas Pogge and Andrew Kuper suggest that we should promote an ‘institutional’ solution to global poverty. They advocate the institutional solution because they think that non-governmental organizations (NGOs) can never be the primary agents of justice in the long run. They provide several standard criticisms of NGO aid in support of this claim. However, there is a more serious problem for institutional solutions: how to generate enough goodwill among rich nation-states that they would be willing to commit themselves to (...) supranational institutional reforms. In the current international political climate, the implementation of such institutional reforms introduces several intractable problems, including difficulties of global coordination and enforcement. I defend the solution of NGO aid from the criticisms presented by Pogge and Kuper, and propose how it might be reformed. My main suggestion is that all practising NGOs should be required to be ‘accountable for reasonableness’ in the sense that Norman Daniels and James Sabin have outlined. (shrink)

This book is born from a desire to understand how Plato influenced and was influenced by the intellectual culture of Western Greece, the ancient Hellenic cities of Sicily and Southern Italy. In 2018, a seminar on Plato at Syracuse was organized, in which a small group of scholars discussed a new translation of the Seventh Letter and several essays on the topic. The seminar was intense but friendly, having attracted a diverse group of scholars that ranged from graduate students to (...) senior professors, hailing from at least three different continents, and representing a variety of academic specialties. We tried to create a book that would invite further study of the topic by identifying new questions to be asked while addressing enduring issues. The essays consider the historical, political, and philosophical implications of Plato’s involvement in Syracuse. They also look at the reception of his voyage among fellow philosophers, ancient and modern. Readers may come to their own conclusions, but one thing is clear: the history of philosophy was profoundly influenced by Plato’s voyages in Western Greece. The book begins with a new translation of Plato’s Seventh Letter by Jonah Radding, as well as the epitaph for Dion attributed to Plato. An introduction by editors Heather Reid and Mark Ralkowski is followed by essays from Carolina Araújo, Christos C. Evangeliou, Filippo Forcignanò, Francisco J. Andrew Reid's essay on the value of education in this journal distinguished the intrinsic features of education from what education is for, the latter being ultimately located in the promotion of personal well-being. At a meta-ethical level, this response accepts Reid's claim about ultimate location, but challenges his view that prudential goods are desire- independent, arguing for a desire-dependent conception based on supra-individual, but not always universal-human, preferences. It also questions his claim that the source of educational (...) value lies in the intrinsic features of education, rejecting the suggestion that epistemological rather ethical considerations should be the starting-point. This paper offers a composite portrait of the concept of magnanimity in nineteenth-century America, focusing on Ralph Waldo Emerson, Margaret Fuller, and Henry David Thoreau. A composite portrait, as a method in the history of philosophy, is designed to bring out characteristic features of a group's philosophizing in order to illuminate characteristic features that may still resonate in today's philosophy. Compared to more standard methods in the historiography of philosophy, the construction of a composite portrait de-privileges the views of (...) individual authors. These philosophers saw the virtue of magnanimity as a remedy for a number of modern ills. American philosophers suggest that the best sort of magnanimity is acquired by adopting the correct relation to the natural world, including new forms of inquiry, or by adopting a life of voluntary poverty. Magnanimous individuals are critics of capitalism and offer themselves as exemplars of a better, experimental life. (shrink)

In recent work, Joshua Glasgow has offered a definition of racism that is supposed to put to rest the debates between cognitive, behavioral, attitudinal, and institutionalist definitions. The key to such a definition, he argues, is the idea of disrespect. He claims: “φ is racist if and only if φ is disrespectful toward members of racialized group R as Rs.” While this definition may capture an important commonality among cognitive, behavioral, and attitudinal accounts of racism, I argue that his attempt (...) to expand the definition to cover institutional or “structural” racism is less persuasive. Alternatively, I argue that structural racism must be understood in terms of injustice rather than disrespect. This involves giving a fuller account of how institutions are related to the beliefs, actions, and intentions of individuals, and thus how they can come to embody a certain kind of agency. (shrink)

When we seek a fuller understanding of individual liberty including its relational character, we confront a conundrum. The evident advantages of a single individual possessing liberty cannot be simply transferred to a greater number of beneficiaries. This conundrum is confronted with the resources of Hohfeld's analytical framework, developed specifically to elucidate the practical outworkings of interpersonal relations within the law. Attention is also paid to concerns expressed by von Wright over a representation of liberty (permission) within the resources of (...) standard deontic logic which fails to address its social aspect. The aggregate level of the Hohfeldian scheme is employed to represent a complete picture of liberty, but one that cannot guarantee benefits for a plurality of holders. The conclusion is reached that in order to extend the advantages of individual liberty to all, something other than liberty is required. (shrink)

Paideia is a word that signifies education or culture—two concepts that are only apparently distinct in Ancient Greek thinking. The performance of poetry, philosophy, rhetoric, drama, dance, and even athletics functioned simultaneously as education and culture. They entertained and unified communities by affirming shared heritage and interrogating common values. This process had special importance in Sicily and Southern Italy, where Hellenism was often a matter of education rather than ancestry. This volume explores the intersection of education and cultural performance in (...) a variety of disciplines and from a variety of perspectives. Authors discussed include Sappho, Empedocles, Gorgias, Plato, and Aristotle. Contexts range from choral dance, to epideictic oratory, theatrical performance, philosophical dialogue, and gymnastic exercise. The Cambridge Companion to Malebranche. Cambridge Companions. New York: Cambridge University Press, 2000. Pp. xi + 319. Cloth, $54.95. With his own Cambridge Companion, the seventeenth-century French philosopher Nicolas Malebranche has at last arrived in the English speaking world. As editor Nadler puts it, "Malebranche was widely recognized by his philosophical and theological (...) contemporaries... as an intellectual force to be reckoned with, a bold... synthesizer of... St. Augustine and Descartes and a systematic thinker of the first rank" (1). Yet until the relatively recent arrival of books or translations by scholars such as Nadler, McCracken, Jolley, Schmaltz, and Riley, Malebranche has largely been treated by Anglo-American scholars as merely the solitary proponent of the allegedly rather silly doctrine of occasionalism. The tide is now turning, and we may expect that over the next few years Malebranche's wide-ranging sophistication and significance will be more widely appreciated. Invaluable to that end will be Nadler's volume, which is of great interest both to those new to Malebranche and to seasoned scholars, for it presents accessible yet thorough introductions to Malebranche's many interesting doctrines—concerning self-knowledge, vision in God, continuous creation, occasionalism, theodicy, grace, freedom, morality, etc.—as well as raises important questions for future research. All of the essays Nadler has assembled are by well-known scholars, and all are worthwhile.The first point to make is that occasionalism—the view that God is the only true cause, and that finite substances lack all true causal power—was neither silly, nor was Malebranche its only proponent. As Nadler's own essay makes clear, the doctrine (or variations thereof) has roots in medieval philosophy as well as in Descartes, and was favored by other Cartesians preceding Malebranche, such as Cordemoy, la Forge, Geulincx, and Clauberg; further, Malebranche offered numerous distinct arguments for it, and, as evidenced in essays by Schmaltz, Rutherford, Kremer, and Riley, intended it to fit with his other metaphysical views in a complete and coherent system. Even if, as some of these same authors suggest, Malebranche failed to get everything to fit quite right, it's at least clear that the oft-raised charge that occasionalism was merely an ad hoc solution to the Cartesian mind-body problem is unjustified. There is of course room to disagree with certain details here: I've argued elsewhere, for example against Nadler, that despite evidence to the contrary Malebranche does not invoke continuous creation as an argument for occasionalism, and, in effect, against Kremer, that Malebranche can succeed in reconciling occasionalism and his conception of free will. But then the fact that scholars can disagree on points such as these is precisely evidence that Malebranche is a rich subject of study.Different essays have different virtues. Some are especially strong in philosophical analysis. Schmaltz provides penetrating analyses of Malebranche's doctrine that we see [End Page 442] all things "in God" as well as of related issues (such as the distinction between the intellectual and the sensible), and also traces their roots in or ramifications for thinkers such as Augustine, Descartes, Arnauld, and Regis; Kremer, too, does an impressive job disentangling the many discrete threads in Malebranche's theory of free will. Essays by Moreau and Riley are particularly useful for their overview or synthetic nature: Moreau presents the many points of contention in the decades-long dispute between Malebranche and Arnauld, while Riley makes explicit the implications that many of the doctrines discussed by other contributors have for Malebranche's moral theory (in the process perhaps implicitly supporting the claim that Malebranche's moral theory may be essential for understanding his metaphysics). Brown's and Robinet's contributions, the former detailing Malebranche's positive influence on or critical reception by figures such as Locke, Leibniz, Berkeley, Hume, and Reid, the latter focusing on disputes between Malebranche, Arnauld, and Leibniz, are essential for those interested (as all should be) in working Malebranche into standard undergraduate courses on modern philosophy, and will also be... In lieu of an abstract, here is a brief excerpt of the content:Classical Rhetoric and the Promotion of the New WorldAndrew FitzmauriceFor many years historians have characterized the relation between the Old World and the New as an encounter in which the New was assimilated to the Old. There is a striking uniformity in the reasons given for this process. It is argued that in their “discovery” the Europeans encountered a world which was radically different from their own and for (...) which they did not possess the concepts to provide a true account. The only available descriptive tools were the categories of European experience. I shall argue that this historical characterization is unsupported by the first English representations of the New World. While it is true that the New World was represented in terms familiar to English audiences, the reason for this translation was dramatically different from that given by historians. The process of conversion to Old World values arises not from an epistemic shock but from the psychology of persuasion found in classical and humanist rhetoric.The purpose of this essay is not to superimpose a new model for under-standing the interaction between Europe and the New World but rather to contribute to recent challenges to precisely the idea that there was a collective European “response” to the New World. Historians who have stressed that the translation of the new into the familiar was imposed by the limits of the European episteme have based these interpretations largely upon accounts of the Spanish conquest, ethnography, and natural history. It has recently been stressed that Europeans differed on the basis of their nationality in their understanding of the issues raised by the conquest of the New World. 1 In this paper I shall argue that the genre of intellectual engagement was equally important to that understanding. Elliott compares the Europeans’ discovery of the New World with the response of the Chinese of the T’ang dynasty to the conquest of Nam Viet. Like the Europeans, the “minds and imaginations” of the Chinese “were preconditioned, so that they saw what they expected to see, and ignored or rejected those features of life in the southern lands for which they were mentally unprepared.” 2 Elliott is careful to observe that “what Europeans saw” on the “far side of the Atlantic” inevitably would “depend on the kind of Europeans involved.” 3 From the example of the Chinese experience of Nam Viet, however, he suggests that Europeans shared in a process through which the New World was assimilated, and he argues that this was epistemic: “it may well be that the human mind has an inherent need to fall back on the familiar object and the standard image, in order to come to terms with the shock of the unfamiliar.” 4Stephen Greenblatt has described this process as rhetorical. He stresses that Europeans possessed “many different and conflicting ways of seeing and describing the world” but claims that “the variety is not infinite,” arguing that Europeans shared “a lumbering, jerry built, but immensely powerful mimetic machinery.” 5 “Wonder,” he argues, is “the central figure in the initial European response to the New World, the decisive emotional and intellectual experience in the presence of radical difference.” 6 For Greenblatt the rhetorical process by which wonder reifies and appropriates the alien arises from an epistemic crisis; that is, wonder is provoked by the “presence of radical difference.” 7 [End Page 222]Underlying many of these accounts, as Mary Fuller has recently observed, is the sense of a New World outside language, a sense that “there is something self-evident, unambiguous, unified on the other side of language.” 8 Fuller explores the rhetoric of New World narratives by demonstrating that this referent is always absent and that the “other” is inside language.For the majority of authors writing in English about the New World, however, it is not the presence or absence of the “other” that produces their conversion of the alien to the familiar. As a distortion of God's created designs, sexual abuse carries a unique devastation-factor. Abuse that is sexual in nature damages a spectrum of internal and external aspects of personhood. In particular, the core realities of: self-identity, community, and spiritual communion with God can be deeply fractured through SA. In light of the significance of the image of God, movement toward healing includes strengthening personal agency, processing profound boundary ruptures, and managing disillusionment with God. Due to the multi-faceted trauma of sexual (...) abuse spiritual formation programs must not only plan for the unique profile of abuse victims, but also need to incorporate a fuller understanding and praxis of the realities of embodiment, ritual, and theocentric metaphor into their transformational goals. This article examines Presbyterian interpretations in Scotland and Ireland of the Scottish Reformations of 1560 and 1638–43. It begins with a discussion of the work of two important Presbyterian historians of the early nineteenth century, the Scotsman, Thomas McCrie, and the Irishman, James Seaton Reid. In their various publications, both laid the template for the nineteenth-century Presbyterian understanding of the Scottish Reformations by emphasizing the historical links between the Scottish and Irish churches in the early-modern period and their common (...) theology and commitment to civil and religious liberty against the ecclesiastical and political tyranny of the Stuarts. The article also examines the commemorations of the National Covenant in 1838, the Solemn League and Covenant in 1843, and the Scottish Reformation in 1860. By doing so, it uncovers important religious and ideological linkages across the North Channel, including Presbyterian evangelicalism, missionary activity, church–state relationships, religious reform and revival, and anti-Catholicism. The demise of the Superconducting Supercollider is often explained in terms of the strain that it placed on the federal budget of the United States, and change in national security interests with the end of the Cold War. Recent work by Steve Fuller provides a framework to re-examine this episode in epistemological terms using the work of Kuhn and Popper. Using this framework, it is tempting to explain the demise as resulting from the overly Kuhnian character of its proponents, (...) who supposedly argued for its construction by appealing to the importance of testing the predictions of a specific paradigm. On this reading, the SSC case appears as an example of how Kuhn’s paradigm-driven view of science was invoked to keep science closed and autonomous from society. I argue that the SSC episode should not be viewed as giving support to the displacement of Kuhn’s view of science for Popper’s, and that such a displacement is detrimental to the project of integrating discussion on science into the public sphere. Drawing upon Rouse and Wimsatt, I argue that understanding paradigms as practices blunts some criticisms against Kuhn’s model, and that his model should play an important epistemological role in the aforementioned project.Keywords: Thomas S. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

This essay examines the funeral sermon given by the Baptist theologian Andrew Fuller (1754–1815) for his friend and deacon Beeby Wallis in 1792 as a vantage-point from which to pursue reflection on Fuller’s concept of heaven and the beatific vision. The sermon has two main themes: the rest and rewards of those who die in Christ. The essay examines how Fuller interprets both of these phrases and then, looking at the rest of Fuller’s corpus, notes (...) that ultimately God himself is the believer’s reward. (shrink)

This article will derive a definition and account of the physically educated person, through an examination of the philosophy of Andrew Reid, Richard Peters and Aristotle. Initially, Reid’s interpretation of Peters’ views about the educational significance of practical knowledge (and physical education) will be considered. While it will be acknowledged that Peters was rather disparaging about the educational merit of some practical activities in Ethics and Education, it will be argued that he elsewhere suggests that such practical (...) activities could be educationally worthwhile in and of themselves. In Education and the educated man he specified that practical activities should be regarded as educationally important if they are either transformed by theoretical understanding and/or pursued to the point of excellence. In suggesting that education involves the cultivation of both theoretical and practical human excellences it is argued that Peters’ philosophy of education begins to take on a more Aristotelian bent. After exploring Aristotle’s notion of virtue (human excellence) and his discussion of physical training in The politics, it is claimed that physical education activities might be most worthwhile when they extend the moral habits and/or modes of thought of pupils, towards excellence. It is concluded that physically educated persons should be defined as those who have learned to arrange their lives in such a way that the physical activities they freely engage in make a distinctive contribution to their long-term flourishing.
